Minutes of the Town of Cross Plains Planning Commission

REZONE PETITION ISSUES
1. The Commission considered Bob Brunner’s request to split one 10-acre parcel in Section 28 into two 5-acre parcels. Splits were available, under the 5 splits in 5 years, and 1 split per 35 acre rules. Baylis made the motion to accept, with a second by Coyle. The motion passed unanimously.
a. Discussion followed about the possibility of Bob Brunner buying a substandard 2-acre parcel from his brother to achieve another split. This was left unresolved. Majid , from County Planning, said Brunner might buy the development rights alone.
b. Brunner’s public hearing at the County is June 26, 2007.
2. Nick Hellenbrand and his wife, who bought a lot in Section 27 for a house, were unsure if they could build the house because the land was zoned A-1. It turned out that the lot was a “grandfathered lot” (established before 1981), thus the zoning had not been changed. They may need to seek a variance because the lot is narrower than the 100 ft. width required. They should do this at the County level. No objections from the Town.
3. Neither the Bahr request nor the Cameron Ramsey request was discussed. The Bahrs were not present. Jones commented that Ramsey would not plan to build because the cost of getting electricity to his site was prohibitive.
COMPREHENSIVE PLANNING – Presentation by Majid Allan
1. He passed out outlines for planning, and requirements for obtaining grants from the State and County. By his recommendation and the previous group discussions, the consensus was to develop the plans by ourselves, with help from:
a. Other plans from other towns are good sources. The plan from the Town of York was shown as an example, and can be found on the County web site.
b. Occasional limited help from the County planners where possible. This help comes with a price tag, but, said Allan, is not as expensive as consultants.
c. Questions about sources of the statistics came from Baylis. Allan replied that Stat sources are good, and UW’s Rural Sociology Applied Population Lab. These are documented in the York plan as an example for us to use. It can be found on the DOA website.
d. Harris mentioned that Aaron Krebs can get the maps we need for $225.
2. Access Dane Website gives good, up-to-date information.
a. Advantage of a subscription to the service is getting all owner information and better bandwidth, and some other info, such as mailing labels.
b. Majid Allan will talk to Brian Standing about which of them should be our main contact.
A Question arose from the citizens about a lot below the Town garage, which is zoned commercial. They said that plans were afoot to put two large 50x50 storage sheds on the lot, but the neighbors had not been notified. They expressed concern about the water run-off and erosion control. The “red tag” meant that the building would have to be approved by the Land and Water Resources Dept of the County – Land Conservation Department. They should check with this department. Louise mentioned that they would come out and look at it. The reason neighbors had not been notified was that the zoning did not need to be changed. Esser asked whether fire inspectors inspect this type of storage shed. The Town hires this out, and the inspectors check every commercial building once a year. No one knew if there were restrictions about what could be stored.
AGREEMENT BETWEEN THE TOWN OF CROSS PLAINS AND THE VILLAGE OF CROSS PLAINS.
The board asked the Planning Commission to make a recommendation whether to re-sign the five-year-old agreement, which was made at the time the golf course proposal was stopped. The agreement concerns cooperation between the Village and the Town on matters of annexation to the Village. Bob Boehnen said the agreement had allowed the Town to get the 17 houses on the Hollfelder parcel. Several people said that it gave us an opportunity to negotiate with the Village we might not otherwise have. Louise Klopp thought that the agreement did not give us anything, and hindered our ability to negotiate with the Village in the area, which is about 1700 acres. The Joint Plan Committee, which is to recommend solutions to the Village and Town boards, has never been set up. Boland mentioned an example from outside the boundary which might want to be annexed along with one inside the boundary, in which case the committee would have some say, with a 2/3 majority. We suggested that Krantz talk to the Village president, Schutz, to ask about their concerns.
Bob Bowman said that we can activate the committee at any time. He mentioned that the cities and villages have more power now than they may have had 5 years ago. The Village has control over the land 1.5 miles from its borders, and can annex land contiguous to its border. A JETZCO is a committee (set up by State statute) for extra-territorial matters which was established for the Ripp and Hollfelder properties, but the Joint Planning Committee had never been set up. Vera Riley suggested signing the agreement for a shorter time, until we have the Comprehensive Plan complete. Esser thought we should sit down with the Village to discuss it before going ahead.
Jones mentioned the potential agreement over Hwy 14 being considered by the Good Neighbor group. He mentioned that the DOT was waiting for them. Louise gave us a map of the water quality corridor. These matters might come under the consideration of the Agreement.
After some discussion of what our motion should say, Williams called the motion, 2nd by Esser: We recommend that the board continue the agreement and appoint the joint plan committee (JPC) as per the agreement. This motion passed 6 to 1.
Discussion with Majid Allan about Hwy 14 and Mineral Pt. Roads followed. He thought we should “suggest” routes in our plan, but not set land aside for such corridors. He also mentioned that Roger Lane is the new zoning administrator for the County.
PLANNING COMMISSION BUDGET (see below)
Harris presented a 2-year budget for the completion of the Plan, with a one-year budget for the routine matters of the Plan Commission. Esser suggested developing one year budgets. After several small additions and explanations about this spreadsheet, the motion was called by Jones, 2nd by Baylis to present the budget, with few alterations and additions, to the Town Board.
QUESTIONS ABOUT THE CLUP (Comprehensive Land Use Plan) SURVEY
Boland asked about how we will go forward with the citizen surveys. All property owners, residents, and other stakeholders will be sent these surveys, but the commission members will make up the questions, including farm questions. We decided not to send out a sample mailing, but to think about it ourselves. Next time we will be putting the first survey together.
