JULY 14, 2008—8:00 P.M.
The Town of Cross Plains Board of Supervisors met for their regular monthly meeting. Notice of the meeting had been published in the Mt. Horeb Mail, Shopper, News Sickle Arrow and on the website. All Board members and approximately 45 citizens were present. The Clerk read the June 9th minutes and after several small changes Vera moved to approve the amended minutes, Jeff seconded and the minutes were approved. The Clerk then read the minutes of the June 26 meeting, Harold moved to approve, Vera seconded and the minutes were approved. Finally the Clerk read the minutes of the July 1 meeting, Harold moved to approve, Vera seconded and the minutes were approved.
PUBLIC COMMENT: Arnie Harris questioned the Board on where were Attorney Corcoran’s records, who is responsible for the records, etc. He closed his remarks with: “the questions will appear in the News Sickle Arrow”. Stefanie Harris requested that the snow plowing policy for the Town be put on the August agenda.
Cheryl Kalscheur appeared requesting a picnic license for the Red Mouse for either August 1st or 8th. They will have outdoor activities from 5:30 to 9:00, fireworks after 9:00 and indoor music thereafter. Harold moved approval, Jeff seconded and the picnic license was approved.
Petition #9922 by Anne Herger to rezone 5.5 acres in Section 17 from A-1 Ex to RH-2 at the corner of Braun and Garfoot was heard. The Plan Commission had recommended approval, Vera moved and Jeff seconded approval, motion passed.
Petition #9932 by Julie Zeimet for Mickelson Dairy to rezone 4.32 acres in Sections 7 and 18 from A-1Ex to RH-2 was next. The Plan Commission had recommended approval with no conditions, Jeff moved to approve, Harold seconded and the motion passed.
Item #5 on the agenda was discussion/action on temporary stay on the remapping of agricultural land in the Town of Cross Plains. It was suggested that this topic be sent to the Plan Commission and they should draw it up and put in what they want then send it to Attorney Schmitt. The next meeting of the Plan Commission is July 21st. Jeff wants the document drawn up as a ordinance and he would move to go with that procedure until we get the Plan Commission recommendation.
The next three items were: Discussion/action on declaration of official public records in the town of Cross Plains, notice of records access and policy on records retention. Harold asked Vera who had drawn up these documents and she responded interested citizens. Harold moved that these documents go to Attorney Schmitt and he look them over and they will be returned for the August meeting, Vera seconded, motion passed.
Both Vera and Carl Jones attended the recent Cross Plains-Berry Fire District meeting. Discussion at the meeting centered on the extra monies the district had received for the new fire engine and what to do with the overage. The District thought the money could be used to update the fire equipment, but not the building. Vera moved and Jeff seconded that we table the decision until the next meeting to get more information, motion passed.
The next agenda item was discussion and possible action on legal counsel. Mr. Schmitt is willing to handle the routine items. Attorney Mark Hazelbaker spoke saying that it is his job to help communities through their problems. He felt that the Town should buy some breathing room, make sure we have the ordinances is place and then move forward with the Faga development. He charges $180 per hour and stated he has the time available. Vera mentioned that some individuals have felt that Mr. O’Connor would be a good fit for the Town. Katy Reeder asked how many Towns Mr. Hazelbaker represents and he stated his credentials. Jerry Schultz felt that everyone should calm down. Stephanie Harris felt that Mr. Hazelbaker has a conflict of interest because of his representation of Dane County Town Association and their support for development. Mark stated that her statement was completely false. Terry Kurth asked that we close this chapter and move on. Jeff moved that we appoint Mr. Hazelbaker the Town’s legal counsel on the matters before us, Harold seconded and the motion passed.
Megan Correll who works for Dane County on the American Transmission Co project made a presentation. She stated that presently there are two main routes, one that will follow the beltline and another that would go through the Town of Cross Plains. The hearings will probably take place in January of 2009. She urged the Town to reactivate the former committee so that our voice can be heard on this matter. She felt that it is vital that we have an organization at the Town level.
There has been no intergovernmental Committee meeting. At the Capital Area Regional Planning Commission Harold reported that Mt. Horeb is requesting a 400 acre TIF district and that Mazomanie is not talking with the Townships.
Vera reported that Northwest Dane Senior Services thanks those who support their organization and advised that next Sunday they will have a booth in Mazomanie.
Harold reported that they are replacing a culvert on Braun Road and that road will be closed on Wednesday and Thursday. He has also stated that it will be necessary for the Town to put a 2 inch mat on Old Military and Applewood. He further reported that some individual had dumped two freezers along the road and they had to be disposed of. He reported about meeting with individuals from Afghanistan to discuss zoning issues.
There were no further fire district updates.
Vera reported that the Town had met on July 1 and made a decision as a result of the attorney records of Ed Corcoran. The Board agreed that the individual Board members should receive the files within five working days and decide what records should be considered privileged and what records were not privileged. After that meeting she had talked to Mr. Corchoran and decided that the records should stay where they were.
Gordie Lamberty reported that the Parks Commission will meet on July 28. He has sold the 30 weather radios he ordered from Dane County Emergency Management. The Park’s Commission meeting will focus on finishing the to-do items started earlier this year. Jeff moved to adjourn at 9:55 p.m., Harold seconded.
